Review & Description

Entertainment Law and Business is a handy resource for both the experienced and novice practitioner. It provides a broad survey of the entire industry and creative rights laws. It includes incisive summaries of all of the important areas of creative rights law: copyrights, the protection of ideas, trademark, publicity and privacy, and the major international treaties. It also provides an overview of all the major fields of entertainment (and related field of interest for entertainment practitioners) along with illustrative agreements. This is not an esoteric academic treatise. The book aims to aid the practitioner in the practical aspects of entertainment. Hence, the authors have attempted to highlight the key features of the major agreements in each field. They provide insights not only into what the individual provisions of the agreement attempts to regulate, but also the concerns that lie behind those provisions. They point to the types of negotiating strategies important in each agreement, passing on their experience to the practitioner. All of the accompanying sample forms and documents are conveniently included on CD-ROM in RTF (Rich Text Format). RTF allows the user to open each sample clause for use/editing in either Microsoft Word or Corel Wordperfect.

Review & Description

This casebook contains 100 decisions in the area of sports law. Many of the decisions affect the rights of athletes in their relations with sports leagues, educational institutions and law enforcement. The decisions are organized by federal circuit and one section contains Supreme Court decisions. The most cited decisions appear higher in each section.

We highlight three recent decisions:

In Brady v. National Football League, 644 F. 3d 661 (8th Cir. 2011), the Eighth Circuit, Court of Appeals ruled on the NFL's appeal of an injunction that prohibited it from continuing to impose a lockout of NFL players. The players alleged that the lockout was a group boycott that violates antitrust laws.

US v. Comprehensive Drug Testing, Inc., 621 F. 3d 1162 (9th Cir. 2010) addresses the federal investigation into steroid use by professional baseball players. The central issue is the procedures that federal courts must observe in issuing search warrants and subpoenas for electronically stored information.

Mayer v. Belichick, 605 F. 3d 223 (3rd Cir. 2010) is a case brought by a fan against the New England Patriots and coach Bill Belichick for their role in surreptitiously videotaping the Jets in violation of NFL rules.
